Probate
Probate is a legal process used when applying for the right to deal with the affairs of someone who has died.
When a deceased person has left a Will, the Executor will apply for a Grant of Probate. This is a legal document that checks that the Executor has the authority to act for a deceased person's estate. The Grant allows the Executor to distribute the deceased person's assets as set out in the Will.
If a deceased person has left no Will, then a close relative can apply to the probate registry to administer the estate. In this case an application for a 'Grant of Letters of Administration' is made. If the application is accepted then a grant is given and this person being the ‘administrator’ can therefore deal with the distribution of the deceased estate.
In some cases a Grant is not always required.
